# Composition Scheme Eligibility: Business Facts to Review Before Opting In ## Identify the precise composition route Composition eligibility should be reviewed for the actual statutory category. The main section 10(1) framework and the section 10(2A) framework are not the same test. A business that cannot qualify under one should not assume it can simply select another category without checking that category's turnover, supply and other conditions. Write the proposed category and the reason it fits your activities. Distinguish manufacturing, trading, qualifying restaurant supplies and other services or mixed activities. A broad description such as “small business” does not identify the correct rule, tax base or eligibility conditions and can conceal a restriction affecting a substantial part of the turnover. ## Reconcile aggregate turnover across the PAN Use the preceding financial year's aggregate turnover for the relevant entry test and monitor the current year as required. Bring together supplies under the same PAN across India, including relevant taxable, exempt and export supplies, while applying the statutory exclusions. Do not assess only one branch's net collections or one marketplace's settlement amount. Notification 14/2019 sets the main route's preceding-year ceiling at ₹1.5 crore, with ₹75 lakh for Arunachal Pradesh, Manipur, Meghalaya, Mizoram, Nagaland, Sikkim, Tripura and Uttarakhand. The separate section 10(2A) route has a ₹50 lakh preceding-year ceiling. Check the applicable route rather than mixing the larger limit with the other route's activity permissions. Illustratively, a proprietor's two shops have ₹62 lakh and ₹48 lakh of relevant preceding-year supplies. The review starts with the PAN-based combined amount, not separate conclusions that each shop is below ₹75 lakh. The applicable State, category, other supplies and conditions then determine whether the business can opt in. ## Map goods, services and activities List each material supply stream and its classification. The main composition route permits a limited amount of services other than the specified restaurant category under the applicable provision. Calculate the permitted amount using the statutory basis rather than assuming that any trader can add unlimited consulting, installation or rental income. The section 10(2A) route is designed for qualifying persons outside the main route, but its own restrictions still apply. Review supplies not leviable to GST and any notified excluded manufacturers or service suppliers. A low turnover does not override an exclusion attached to the activity itself. Keep product classification evidence for goods subject to notified exclusions. Do not use a short generic description such as “building products” where the actual tariff classification determines eligibility. Notifications have been amended over time, so review the current excluded list for the real goods instead of treating the first 2019 table as an exhaustive permanent list. ## Review outward geography and platforms Check whether the business makes inter-State outward supplies. That restriction is different from purchasing goods from another State or receiving services from a supplier elsewhere. Map the actual outward supply and place-of-supply facts rather than judging solely from where a customer's payment bank is located. Review online selling with the updated framework. From 1 October 2023, Notification 36/2023 provides a procedure for relevant goods supplies through e-commerce operators by composition taxpayers. The operator must not permit inter-State goods supplies through that route and must perform the specified TCS and reporting tasks. It is not a blanket permission for every online model. Services through an operator required to collect tax under section 52 have a separate statutory restriction. A business offering both goods and services on platforms should classify the streams separately and check the actual operator role. Owning a website, selling through a marketplace and supplying a notified service are not interchangeable facts. ## Check status and common-PAN conditions Casual taxable persons and non-resident taxable persons are excluded from the composition framework under the relevant conditions. A temporary exhibition business should not choose composition solely because its expected event sales are small. Determine the correct registration category first and then assess whether that category can use the scheme. Where more than one registration exists under the same PAN, the statutory common-PAN conditions need review. Do not let each State office choose a tax method independently without considering the other registrations. A new branch or altered supply activity can affect the position beyond the branch where the change first occurs. Create a register of all GSTINs, their category, activities and responsible person. Confirm the intended scheme position across that register before filing. Keep supporting turnover statements and declarations from the people who control the different businesses, especially where the owner operates several brands with separate accounting staff. Check the calendar year labels in the turnover working. A sales report for the last twelve months may not be the preceding financial year required by the provision. Preserve the exact period used and reconcile it to the financial-year records before relying on the total. ## Monitor eligibility after entry Composition remains available only while its conditions continue to be satisfied. Track turnover and material changes during the year, including new inter-State orders, new service lines, different goods and additional platform models. A successful opt-in does not establish eligibility permanently for transactions the business had not yet begun making. Set review triggers in purchasing and sales approval workflows. For example, a proposed nationwide delivery campaign should reach the person monitoring composition before the first inter-State order is accepted. Waiting until the annual return may leave many transactions requiring correction and a missed exit event. Keep a dated eligibility file with the chosen category, calculations, official provisions relied on and the facts that must remain true. That gives the owner a clear basis for entering the scheme and a practical warning system for when normal taxation or another change must be reviewed. ## Sources and references - [CBIC: Central Goods and Services Tax Act, consolidated through August 2021](https://cbic-gst.gov.in/pdf/CGST-Act-Updated-31082021.pdf) - [CBIC: CGST Rules, official compilation including registration amendment rules](https://cbic-gst.gov.in/pdf/10112020_CGST-Rules-2017_Part-A_Rules.pdf) - [Notification 14/2019-Central Tax: composition turnover limits](https://gstcouncil.gov.in/sites/default/files/2024-05/notfctn-14-central-tax-english-2019.pdf) - [Notification 36/2023-Central Tax: goods supplied through ECOs by composition taxpayers](https://gstcouncil.gov.in/sites/default/files/2024-05/gst-ct-36-2023.pdf) - [GSTN: Applying for normal taxpayer registration](https://tutorial.gst.gov.in/userguide/registration/Apply_for_Registration_Normal_Taxpayer.htm)
